1. Information About Us

These Terms of Sale govern purchases made through the Big John's website and official mobile applications.

2. Definitions

App means any official Big John's mobile application. Contract means the legally binding agreement formed when an Order is accepted. Consumer means an individual acting outside their trade or profession. Order means a request to purchase Products. Order Confirmation means our acceptance of your Order. Products means food, beverages and other items sold through the Site or App. Site means the Big John's website.

 

3. About These Terms

By placing an Order you confirm that you have read and accepted these Terms. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable legislation.

 

4. Access to Our Website and Mobile Applications

Access is provided free of charge. We may modify, suspend or withdraw the Site or App for maintenance, updates or operational reasons.

 

5. Eligibility to Purchase

You must have legal capacity to enter into a binding contract and provide accurate information when placing an Order.

 

6. Age-Restricted Products

Age-restricted Products may only be purchased by customers aged 18 or over. Valid photographic identification may be requested upon collection or delivery and supply may be refused if satisfactory identification is not produced.

 

7. Delivery Areas

Delivery and collection are available only within areas shown during checkout and may vary depending on operational capacity, courier availability and restaurant opening hours.

 

8. Products, Allergens, Pricing and Availability

Product images are illustrative only. Ingredient and allergen information is provided where available; however, our kitchens handle multiple allergens and we cannot guarantee products are free from traces. All Products are subject to availability. Prices include VAT where applicable and may change before an Order is accepted. Obvious pricing errors may result in cancellation before acceptance.

 

9. Placing Orders and Contract Formation

Submitting an Order constitutes an offer to purchase. A Contract is formed only when an Order Confirmation has been issued. We may refuse Orders for operational, technical, payment or fraud-related reasons.

 

10. Payment

Payment must be made in full before preparation begins. Payments are processed securely by authorised third-party providers. Promotional offers may be withdrawn, amended or refused where misuse is identified.

 

11. Delivery and Collection

Delivery and collection times are estimates only. Delays may arise due to traffic, weather, courier availability or exceptional demand. Customers must provide accurate delivery details. Collection Orders should be collected promptly and uncollected Orders may be disposed of for food safety reasons.

 

12. Ownership and Risk

Risk passes when Products are delivered or collected. Ownership passes once payment has been received in full.

 

13. Problems With Your Order

If Products are missing, incorrect or unsatisfactory, please contact support@food2go.co.uk as soon as possible and, where practicable, within 24 hours. We may request photographs and Order details before assessing an appropriate remedy.

 

14. Cancellations and Consumer Rights

As Products are freshly prepared and perishable, the statutory 14-day cooling-off period does not apply once preparation has begun. Cancellation requests before preparation may be accepted at our discretion.

 

15. Refunds and Remedies

Where appropriate we may offer a replacement, partial refund, full refund, account credit or loyalty credit. Refunds are normally made to the original payment method.

 

16. Website and App Availability

We do not guarantee uninterrupted access to the Site or App and may suspend services for maintenance, updates or technical reasons.

 

17. Intellectual Property

All intellectual property rights in the Site, App, branding, logos, images and content belong to Big John's or its licensors and may not be reproduced without our prior written permission.

 

18. Limitation of Liability

Nothing excludes liability that cannot legally be excluded. Subject to applicable law, we are not liable for indirect or consequential losses or business losses.

 

19. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including severe weather, industrial action, power failures, transport disruption or government restrictions.

 

20. Privacy and Personal Data

Personal data is processed in accordance with our Privacy Policy and applicable UK data protection legislation.

 

21. Other Important Terms

We may transfer our rights under these Terms. If any provision is unenforceable, the remaining provisions continue in effect. Delay in exercising rights does not waive them.

 

22. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Consumers retain any mandatory rights applicable in their country of residence within the UK.
